Terms of Service

• "Account" means a unique login registered on our Service.
• "Tenant" means a business entity that has registered and uses the Service.
• "User" means an individual authorised by a Tenant to access the Service.
• "Subscription" means the paid plan under which a Tenant accesses the Service.
• "Data" means all information submitted by Tenants or Users to the Service.
• "GCC" means the Gulf Cooperation Council region including UAE, KSA, Qatar, Kuwait, Bahrain, and Oman.

To use the Service, you must register an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept all risks of unauthorised access.
• Promptly notify us at legal@amanaerp.com of any breach or unauthorised use.
• Be responsible for all activity that occurs under your account.

You must be at least 18 years of age and have legal authority to enter into these Terms on behalf of the business entity you represent.

Access to the Service requires a paid Subscription. By subscribing, you agree to the following payment terms:

• Billing. Subscriptions are billed in advance on a monthly or annual basis. Fees are charged in AED (United Arab Emirates Dirham) unless otherwise agreed.
• Free Trial. New accounts may receive a free trial period as stated at the time of registration. At the end of the trial, your Subscription will automatically begin and your payment method will be charged unless you cancel before the trial ends.
• Auto-Renewal. Subscriptions automatically renew at the end of each billing period. You may cancel at any time from your billing settings at https://app.amanaerp.com/settings/billing.
• Price Changes. We will provide at least 30 days' notice of any price changes. Your continued use after the price change takes effect constitutes acceptance.
• Refunds. Fees are non-refundable except where required by applicable UAE consumer protection law or as expressly stated in these Terms.
• Taxes. Prices are exclusive of VAT. VAT at 5% will be added where applicable under UAE Federal Law No. 7 of 2017 on Tax Procedures.

You agree not to use the Service to:

• Violate any applicable law or regulation in the UAE or any GCC country.
• Upload, transmit, or store any data that infringes intellectual property rights.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to process data of sanctioned individuals or entities.
• Resell or sublicense access to the Service without our prior written consent.
• Use automated scraping, crawling, or data extraction tools against the Service.

Your Data. All Data you submit to the Service remains your property. We do not claim ownership of your Data. You grant us a limited licence to store, process, and transmit your Data solely to provide the Service.

Data Processing. We process your Data in accordance with our Privacy Policy and, where applicable, our Data Processing Agreement.

Data Residency. Your Data is stored on servers located in the GCC region (AWS Bahrain region, me-south-1) by default.

Data Export. You may export your Data at any time using the Import/Export feature. Upon termination, we retain your Data for 30 days before permanent deletion.

We target 99.9% uptime for the Service, excluding scheduled maintenance windows. We will provide at least 48 hours' notice of planned maintenance. Uptime statistics are published at status.amanaerp.com.

The Service and all its components are the exclusive property of AMANA Technologies LLC and are protected by UAE intellectual property law. You may not copy, modify, distribute, sell, or lease any part of the Service, nor reverse engineer or attempt to extract its source code.

To the maximum extent permitted by UAE law, AMANA Technologies LLC shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, data, goodwill, or business opportunity.
• Damages arising from unauthorised access not caused by our negligence.
• Service interruptions beyond our reasonable control (force majeure).

Our total liability shall not exceed the fees paid by you in the three months preceding the claim.

You agree to indemnify and hold harmless AMANA Technologies LLC from any claims arising from your violation of these Terms, unauthorised use of the Service, your Data infringing third-party rights, or your violation of any applicable law.

By you. You may cancel your Subscription at any time from your billing settings. Cancellation takes effect at the end of the current billing period.

By us. We may suspend or terminate your account for breach of these Terms, non-payment, or legal requirement. We will provide 14 days' notice except in cases of serious breach or legal obligation.

Effect of termination. Your Data will be retained for 30 days following termination, after which it will be permanently deleted.

These Terms are governed by the laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE. Before initiating formal proceedings, contact us at legal@amanaerp.com — we will respond within 10 business days.

We will notify you by email at least 14 days before material changes take effect. Your continued use after the effective date constitutes acceptance.
